The mission of the Northern California ACAMS Chapter is to support the goals of the International ACAMS organization to provide outstanding learning and training events and professional development opportunities, as well as support for its members' needs in the AML industry. The Chapter will strive to fulfill its mission by: educating and training AML professionals in private and government organizations regarding anti-money laundering and fraud detection specific to our area, such as technology related fields and our relations with Pacific Rim countries; bringing educational resources on an international level to our local area to reduce costs and save time for our members; and collaborating and networking with other local AML professionals to increase industry knowledge and job effectiveness from this interaction and exposure.

Model Risk Management
Institutions of every size are implementing and relying on complex systems and models, such as transaction monitoring systems and customer risk models, for AML compliance. Failure to identify systemic gaps or weaknesses within AML models is often the leading attribute of fines, penalties, enforcement actions, and mandated look-backs.
This Learning Event will discuss recent AML model risk management trends and examiner expectations, prescriptive approaches to managing AML model risk, and how you can use technology to apply sound model governance standards and practices to your AML models.

Allie Suazo from Bank of Marin presented the new CTR form. Field by field, she provided details into what will soon be required. Erik Mineishi from Union Bank presented the new SAR form. He provided some great information about what FinCEN has stated they are expecting to see in certain fields. Finally, Pam Bowersox from First Technology Federal Credit Union, provided an overview of their BSA operation. This provided insight into a mid-sized credit union based in the Silicon Valley for those Chapter members who may not be that familiar with how a credit union's BSA program might operate.

The event was sponsored by Verafin, a company that offers BSA/AML solutions including a solution to file CTRs and SARs using the new form.
On August 23, 2012 the Northern California ACAMS Chapter descended upon Golden Gate University in downtown San Francisco to hear from two eclectic speakers: Steve Wallace, BSA/AML Officer at First Republic Bank and Alex Seddio of Alex Seddio & Associates.

In the University's stadium seating, about 40 local BSA/AML professionals listened and participated in discussions on identifying beneficial ownership and the difference between tax avoidance and tax evasion.
"Tax avoidance is legal. However, tax evasion is illegal!" remarked Seddio who worked with the IRS – Criminal Investigation Unit in his previous career. In his presentation he defined tax avoidance as the legitimate minimizing of taxes using legal methods.
On the other hand, tax evasion is illegal and he defined it as the intentional and illegal practice of not reporting income, reporting deductions not legally allowed, or by not paying taxes owed.
Wallace gave a solid presentation on the rules of beneficial ownership. According to the USA PATRIOT Act, Section 312, financial institutions are required to perform due diligence, and in some cases enhanced due diligence, with regard to correspondent accounts established or maintained for foreign financial institutions and private banking accounts.
Wallace cited a few case studies for the failure to identify the beneficial ownership of accounts, pinpointing the Permanent Sub-Committee on Investigation's review (PSI) on Riggs Bank.
After the presentation, discussions continued at a local venue with drinks.

Brian is a recognized expert by the The Wall Street Journal in financial crimes and currency exchange. He specializes in convergent risk management, financial intelligence in anti-money laundering, fraud, terrorist financing, cyber analytics, and data leakage for commercial and government clients. Brian co-authored the first publication to assess the compliance and financial crimes risks of bond swaps known as "permutas" using offshore jurisdictions in parallel markets. Since publication, the U.S. has issued indictments in two separate high-profile money laundering cases, which allege the parallel market was used to launder narcotics proceeds.
Brian previously served as Vice President for OneWest Bank, a $27 billion private equity owned Southern California bank, where he developed the enterprise-wide BSA/AML/Fraud program. Moreover, as a member of OneWest's Enterprise Risk Committee, he managed the integration of three failed financial institutions OneWest purchased from the FDIC.
He serves as the Chair of the ACAMS Chapter Steering Committee and is an Executive Board member of the ACAMS Northern California Chapter. Prior to relocating to San Francisco, Brian served as a founding Executive Board member of the ACAMS Southern California Chapter. He is a speaker and instructor at international and regional financial crimes conferences and training sessions. Brian has presented on the financial crimes risks of mergers and acquisitions, mortgage loan fraud, permutas, foreign currency exchange, money service businesses, enhanced AML techniques, and the Pop Culture Project, a unique training method that blends social media, visual imagery, and digested case studies.
He received his Juris Doctor from New York Law School and his Bachelor of Arts from Stony Brook University. He is a Certified Fraud Examiner (CFE) and a Certified Anti-Money Laundering Specialist (CAMS).

Lisa Lechner, CAMS

Lisa has worked in Legal and Compliance roles within various financial service industries since 1995 including MSBs, credit & collections, and securities. Lisa is currently the Head of Compliance Platforms for AVG Technologies focused on the creation of their compliance program, certification scheme and monitoring for anti-virus, downloads and advertising fraud. Prior to that, Lisa worked at PayPal since 2003 where she was one of the founding members and leaders of their Global AML/CTF Program. While at PayPal, she created and managed numerous facets of the Global AML/CTF program and policies including: OFAC and Global Sanctions, ECDD, FCPA, SAR and FIU program, 314(b) and Law Enforcement response, Training, and Transaction Monitoring. Lisa specialized in building global strategies for prevention and detection programs including the implementation of an enterprise-wide compliance platform (including a successful remediation) and building out numerous teams and business cases to support them Most recently she was the Director of the Compliance Strategy, Product Review & Analytics which was a team specialized in the development of compliance strategies for new products, partners, global expansion initiatives, M&A, and for ongoing compliance program development and regulatory reviews.
Lisa is a speaker at national and international compliance forums where she focuses on implementing compliance programs (focused on AML/CTF, unique risk, transaction monitoring and identity) and strategies for unique and emerging business models. Lisa also speaks about Emerging Payment Technologies to other industry groups.
Lisa serves as Co-Chair on the ACAMs Northern California Chapter and on the Northern California HIFCA Banking Roundtable. She received her Juris Doctorate from the University Of Nebraska College of Law and has a B.S. degree in Political Science from Nebraska Wesleyan University. Erin is a Compliance Manager for Google, specializing in electronic payments. Erin joined Google in 2009 and manages the global AML and KYC program, the Google-wide Sanctions program, and the Compliance Training program. Prior to joining Google, Erin worked as the SAR manager for a subsidiary of Bank of America for 5 years, where she was responsible for, among other things, creating a SAR program, training on and developing a program for BSA compliance, managing the OFAC program, being the liaison with law enforcement, and handling consumer complaints. Prior to working for Bank of America, Erin worked on HMDA compliance. Erin earned her MBA at San Jose State and her BAs in Music and Politics from the University of California at Santa Cruz.

Paul Beers

Paul Beers is the Director of AML Investigations for Wells Fargo & Co. In this role, he oversees the detection, investigation, and reporting of suspicious activity related to money laundering and terrorist financing for over 80 lines of business across the enterprise. He and his staff of investigative and management personnel conduct nearly 80K investigations each year as part of Wells Fargo's global AML program.
Prior to joining Wells Fargo in 2007, Paul served for eleven years in the U.S. Department of Justice where he was a Supervisory Special Agent for the Drug Enforcement Administration. He was certified as an expert in U.S. District Court on money laundering issues. Paul holds a B.S. in Finance and a Master of Business Administration.

Jenner Balagot, CAMS

Jenner is a Certified Anti-Money Laundering professional and has been involved in BSA/AML matters for over seven years. Currently, he belongs to the Financial Intelligence Unit and manages the CTR and OFAC program. Previously, he worked at Wells Fargo Bank, where he helped build the Identify Program. His introduction to the BSA/AML world occurred during an internship with the U.S. State Department, in Manila, Philippines, where he worked with the World Bank, International Monetary Fund, and other foreign governments.
He has a Bachelor of Science degree, in Information Systems Management, from the University of California, Santa Cruz. He is also a member of the World Affairs Council, San Francisco Chapter.

Amanda is currently Vice President and Compliance Officer within the Corporate Compliance BSA/AML Program Team at Bank of the West. She has over 14 years of financial services experience and six years of experience in the BSA/AML/OFAC space. She is an active member of the California Bar Association and a Certified Anti-Money Laundering Specialist. Previously, she was a Senior Audit Leader at Wells Fargo acting as an Auditor in Charge of complex BSA/AML/OFAC audits and acted as a subject matter expert on line of business audits where BSA/AML/OFAC was involved. Prior to her position at Wells Fargo, she was First Vice President and AML Compliance Officer for the former United Commercial Bank, a $13 billion bank headquartered in San Francisco. She received her J.D. from John F. Kennedy University, School of Law and received her B.A. from the University of California at Berkeley, with a major in Legal Studies and a minor in Ethnic Studies.

Robert "Bob" Kenny

Bob is a Senior Intelligence Research Specialist with the Financial Crimes Enforcement Network (FinCEN), and has been with FinCEN since May 2004 working as a liaison for FinCEN in the Northern California Region and as the FinCEN Representative to the San Francisco High Intensity Financial Crimes Area (HIFCA) Task Force, where his primary duties involve conducting analytic work in support of financial investigations and providing liaison assistance to law enforcement agencies in the Northern California area on FinCEN related issues. Prior to his assignment with FinCEN, Bob spent over fourteen years with the Department of Defense as a Supervisory Intelligence Research Specialist, senior analyst, and operations officer in California, working in support of law enforcement and intelligence community efforts related to criminal investigations and operations. In addition to his role in the Northern California Chapter of ACAMS, Bob is a member of the International Association of Law Enforcement Intelligence Analysts, and received his certification as a Criminal Analyst in 1999 to become a member of the International Society of Certified Criminal Analysts (SCCA).

Perla Ortiz, CAMS

Perla serves as Chief Compliance Officer at Commonwealth Foreign Exchange, a market-leading foreign exchange services firm focused on facilitating currency exchange on behalf of domestic and international corporations. She manages the BSA/AML and OFAC programs and institutes internal controls to ensure compliance with the National Futures Association. Perla is responsible for the development and implementation of the proprietary compliance risk and transaction monitoring software.
Previously, she served as Vice President and BSA Officer for Merchants Bank of California, N.A., where she managed the BSA/AML program for the multi-national retail bank and its Unigram money transmitter service that provides transfers to Mexico and Central and South America. Prior to joining Merchants Bank, Perla was an Education and Training Specialist for ACAMS. She was responsible for the development and planning of anti-money laundering conferences and seminars and conducted marketing studies to promote the growth of ACAMS. Perla received her Bachelor of Science in Chemical Engineering and a Minor in International Relations from the Georgia Institute of Technology. She is a Certified Anti-Money Laundering Specialist and a member of the ACAMS Annual Conference Task Force. Perla is an executive board member of the ACAMS Northern California Chapter and also serves on the Northern California HIFCA Banking Roundtable.

Erik Mineishi, CAMS

Mr. Erik Mineishi is presently the VP Special Risk Client Unit Manager at Union Bank, located in San Francisco, CA. His financial experience expands over 13 years with financial institutions of varying size that include credit unions, community and regional banks, credit institutions and national banks.
Erik's experience began working on development of CIP/CDD programs for small to mid-size institutions, and later expanded his experience to include implementation of transaction monitoring programs and case management systems with large national institutions that included Washington Mutual and Wells Fargo Bank. Erik's has an extensive understanding of database technologies and AML typologies which he has used to assist institutions mitigate BSA and sanctions related risks.
In Erik's latest role with Union Bank, he is responsible for managing Enhanced Due Diligence and transaction monitoring oversight of the bank's highest risk clients and products. This role manages BSA risks from the on-boarding of new clients, to ongoing monitoring, and suspicious activity filings (cradle to grave).

Arjun is a Manager in Crowe Horwath's Risk Consulting practice where he assists financial institutions with various federal and state regulatory issues. His primary focus over the last eight years has been in leading efforts to assist financial institutions with the operational aspects of their Bank Secrecy Act (BSA) and Anti Money Laundering programs. During this time Arjun has led engagements to develop comprehensive AML programs in response to regulatory actions and in the design and implementation of technology to address complex business issues facing the banking industry. Arjun has also performed AML and fraud investigations, BSA audits for banks and Money Service Businesses, implemented transaction monitoring and enterprise-wide case management systems and assisted with defining and structuring organizations' Financial Intelligence Units (FIU). He has also developed training programs for conducting investigations and identifying suspicious activity and has trained numerous bank personnel as well as internal resources in the fields of investigations and transaction monitoring.
As a transaction monitoring subject matter expert, Arjun was instrumental in designing Crowe's transaction monitoring tuning methodology and subsequently has led the effort to refine the methodology in the face of evolving regulations and technologies. He also played a significant role on the team that developed Crowe's proprietary system tuning software, Crowe Caliber™. Leveraging Crowe's system tuning methodology and technology, Arjun consults with his clients to improve the quality of suspicious activity alerts and more effectively utilize the organization's resources, regardless of the transaction monitoring system they use.
Arjun received his M.B.A from the Stephen M. Ross School of Business at the University of Michigan, Ann Arbor, and his Bachelor of Arts in Applied Mathematics and Economics from the University of California, Berkeley. He is a Certified Anti-Money Laundering Specialist (CAMS) and serves on the Young Professionals Board for Junior Achievement of Northern California.
