How to Build an Effective Due Diligence Program

Examiners’ Review of the New FFIEC BSA / AML Manual
July 7, 2010

With the release of the FFIEC 2010 BSA / AML Examination Manual on 4/29/10, this interactive two hour session focused on the many changes throughout the manual with Federal Reserve Bank Examiners Vincent J. Danno and Karen M. FINRA Insights – The Dynamics of a Broker / Dealer & Financial Institution AML Program
June 3, 2010

Featured speaker Shawn O’Neill, FINRA Examination Manager, provided important insight on the coordination of AML programs between the Broker/Dealer and the financial institution.  Shawn also covered best practices, recent examination findings and how to avoid them, types of unusual activity to be concerned with, and SAR filing examples.  Special guest speaker John Byrne, executive VP, ACAMS, provided a brief welcome message with Jack Oskvarek, Chapter Chair.  This event was proudly sponsored by Deloitte   and held at their downtown Chicago office. 


 

How to Complete an Effective SAR & How Law Enforcement Uses Them
March 10, 2010

Workshop attendee Brandi Wolfinger, CAMS, with Park National Bank, now part of U.S. Bank commented “I found it helpful to get an idea of what the various law enforcement divisions look for in the narrative of a SAR so that we are able to streamline our process and include only information that is useful to them.” ACAMS Chicago Chapter Chair Jack Oskvarek added that having a thorough and periodic review of a core AML function such as SAR filing is essential to maintaining a high quality program. The expert panel presentation was provided by Ronald H. Braver, IRS-CI, Supervisory Special Agent, CPA, CFE, CAMS; David Barth, IRS-CI, Special Agent; and Thomas Moriarty, Special Investigator, U.S. Attorney’s Office.

Panel speakers Michael Forester, Managing Director of CrossCheck Compliance; Shaun Hassett, VP Practice Leader of The LUBRINCO Group; and Ralph Dahm, President of I.T. Audit provided attendees with practical and real life knowledge of the growing challenges of mortgage fraud. In Jack Oskvarek’s (Chapter Chair) introductory message, he spoke of the importance and challenges of identifying violations beyond the normal reportable AML issues. “A workshop such as this on mortgage fraud helps broaden our knowledge of what’s going on around us.” Jack referenced a short video clip that demonstrates how easily it is to miss the obvious.   BSA / AML Emerging Trends

  Electronic Banking: AML Risks, Requirements & Recent Cases
October 15, 2009

Russell Cronan, Sr. National Bank Examiner with the OCC presented a comprehensive overview of a number of leading-edge discussion topics within the framework of e-Banking and AML risks, including: ACH, stored value cards, RDC (Remote Deposit Capture), RCC (Remotely Created Checks) payment processors, internet gambling, mobile banking, and virtual worlds. Also covered were recent cases and industry developments. Workshop attendee Jorge Solis of First Midwest Bank commented that the session provided a more in depth and thorough discussion of key issues.


  Cyber Crime Treat: An FBI Perspective
Monday, May 26, 2009

FBI Special Agent Brent Dempsey was featured at the 5/26/09 workshop which was sponsored and held at Crowe Horwath LLP. The presentation gave an overview and trend of cyber crime threat that the FBI sees today. There was a discussion of the resources devoted to cyber crime and the challenges faced by law enforcement.  Examples were given of modern organized crime operations built around converting hacking into dollars. Also discussed was the evolution of hacking into a profit motivated endeavor and some of the recent advances made by hackers.  Finally, there was a discussion of resources available to the public and businesses to educate themselves, to report cyber crime, and the tools available to protect yourselves.

Jack Oskvarek is Vice President, BSA/AML/OFAC Manager and Board of Director approved BSA Officer for Banco Popular North America (BPNA).  Prior to joining BPNA in March 2010, Jack served in similar roles at Park National Bank and AMCORE Bank.  In July 2007 he was brought in to AMCORE Bank to navigate through an OCC formal agreement and consent order and build a comprehensive BSA/AML/OFAC program and team.  Functioning in this integral role, all adverse OCC regulatory actions were lifted in April 2008.  Jack was also responsible for overseeing Deposit Operations.  Jack has more than 25 years of banking experience.

Prior to joining AMCORE in July 2007, he was First Vice President, BSA Officer & Deposit Operations Manager at MidAmerica Bank, where he was responsible for bank-wide AML/BSA/OFAC functions (completing a full AML/FIU build-out of personnel and systems), deposit operations, servicing departments, wire operations, internal help desk, and contact center.  Prior to MidAmerica Bank, Jack served as Vice President, BSA Officer & Manager of Retail Banking Operations at TCF Bank (Standard Federal Bank), which included AML/BSA/OFAC functions, loss prevention/fraud operations, compliance, branch management, and was Plan Trustee for a $10 million employee pension portfolio.

Jack earned a bachelor’s degree in business with a finance concentration from De Paul University.  He is a Certified Anti-Money Laundering Specialist (CAMS designation from the Association of Certified Anti-Money Laundering Specialists) and is a certified Anti-Money Laundering Professional (AMLP designation from BAI).

Most recently, he was instrumental in forming the ACAMS Chicago Chapter and currently serves as Chairman.  He has also served on various panels such as the ABA AML National Conference in Washington D.C. in fall 2008.  Outside his professional life, Jack is an avid tennis player and a dedicated Cubs fan.

Kimberly Ellinger, CAMS

Kimberly Ellinger is an Assistant Vice President in the Commercial Banking AML group. Kimberly is responsible for the identification and review of high risk customers within the Commercial Bank.  Prior to joining JPMorgan Chase, Kimberly worked for Crowe Chizek as a manager in the firm’s AML consulting practice. While there, Kimberly focused on transaction monitoring and money laundering investigations. Kimberly has acted in the Quality Control function for multiple areas of the investigative process including analysis, investigation, and Suspicious Activity Report preparation. She has also completed several Risk Assessments in which she was responsible for identifying high-risk activities within the institution.  Kimberly has also been involved in the creation of Financial Intelligence Units within financial institutions. This has involved training employees, creating manuals and other reference documents, and providing Bank management with information to make informed decisions. Tara Dabek is a member of the Risk Management Department of Citizens First National Bank. She joined CFNB in May 2010 and is heavily involved with the daily BSA related duties. Prior to joining CFNB, Tara worked as a Bank Consultant Supervisor for Lindgren, Callihan, Van Osdol & Co. Ltd. for over five years, specializing in BSA, ACH, and Compliance. Fredia Wynne is a Vice President and the Bank Secrecy Act Officer for RBS WorldPay U.S., the U.S. payments processing division of The Royal Bank of Scotland. She is responsible for the implementation of the AML and OFAC programs which includes oversight for the identification, assessment and mitigation of money laundering and terrorist financing risk; policies and procedures; monitoring and reporting of suspicious activity; and AML training. She has more than 20 years experience in the financial services industry. Prior to joining RBS WorldPay, U.S., Fredia worked for Bank of America as a Senior Vice President in the AML Compliance group supporting the Bank’s broker-dealer. Fredia is a Certified Public Accountant and has attained the CAMS, CRCM, and CRP compliance designations.

Matt Weberling has worked in banking since the age of 16 when he began as a Bank Teller at Mid America Bank in 1996 and worked through the end of college in 2002. After graduation from the University of Iowa he began as a Loss Prevention Analyst at Mid America Bank in 2003 and worked full time while also attending graduate school. In October 2005 Matt was selected to be part of a project team to build out a Financial Investigations Unit (FIU) and implement a BSA/AML program at Mid America Bank. He received investigative training from former Federal Law Enforcement agents from the Criminal Investigation Division of the IRS and U.S. Treasury Dept. After successfully helping as a key team member specializing in writing and preparing suspicious activity reports he was hired on as a charter member of the department and full time Anti-Money Laundering analyst and worked in that position from 2005 through the acquisition of Mid America Bank by National City Corporation ending 11 years of service at Mid America in March 2008. He immediately obtained a position at MB Financial Bank in March 2008 as an Anti-Money Laundering Investigator and is presently working in that position in Rosemont, IL. He has completed thousands of investigations that have resulted in over 850 career SAR filings between two $10+ billion asset size banks. He obtained his CAMS certification in 2007 and was a charter member of the Chicago Chapter of ACAMS.

He attended the University of Iowa in Iowa City, Iowa from 1998 until 2002 graduating with a Bachelor of Arts degree (B.A.) in history. He also received a Master’s Degree of Education (M.Ed.) from DePaul University in Chicago in 2007.

Teri Downey is the Risk Management Compliance Manager for RSM McGladrey’s Great Lakes practice. Teri has 10 years of experience in internal audit and regulatory compliance for financial institutions ranging in size from $40 million in assets to $5.5 billion. Teri’s internal audit experience is focused in commercial, real estate and consumer lending, while her compliance experience includes BSA/AML and OFAC, retail, mortgage and commercial lending, HMDA/CRA, deposit and retail operations regulations, Regulation O and GLBA/Privacy. Teri graduated from Rockford College with a Bachelor of Science degree in Accounting. Paulina M. Prebe, CAMS

Paulina M. Prebe currently holds an AML Officer/Quality Assurance Analyst position with Harris N.A. as of March 2010. Her duties consist of performing independent AML testing of high risk business lines to ensure quality and effectiveness within the AML Unit. Prior to joining Harris N.A. she was the BSA Department Team Lead at Park National Bank (now part of U.S. Bank), where her primary role consisted of quality assurance and oversight of daily department functions. During her employment with Park National Bank, Paulina started as a BSA Analyst and then was promoted to a Senior Analyst in 2008, and then to the BSA Department Team Lead in 2009. Prior to joining Park National Bank in September 2007, Paulina was employed by MidAmerica Bank from 2002 and served an array of retail front line positions. In 2006, Paulina moved to the Loss Prevention Department as an analyst and finally in early 2007 began her career in Anti-Money Laundering (also with MidAmerica Bank), as an AML Analyst where her primary role consisted of conducting case file investigations.

Paulina graduated from University of Illinois at Chicago in 2005 with a Bachelor’s Degree in Liberal Arts and Sciences, majoring in Criminal Justice. She also has been a Certified Anti-Money Laundering Specialist (CAMS) since 2008.

Greg LeMond is an Executive at Crowe Horwath LLP and is the firm-wide solution owner for AML Investigations & Reporting and AML Lookbacks. He has been a Project Manager on some of the firm’s largest projects including assisting institutions that have been under enforcement actions or regulatory scrutiny. His multi-disciplinary projects have included exam response management, AML Lookbacks, AML Risk Assessments, financial intelligence unit development, transaction monitoring optimization and risk-based customer due diligence. Greg’s most recent project success included assisting the bank with successful compliance to an enforcement action. Greg has presented on several AML topics including an on-line webinar on Lookback Execution and Approach.

Brian Arrington has over 12 years of experience in the financial services industry. Brian provides seasoned experience in BSA/AML compliance and has had diverse assignments with financial institutions. He is highly familiar with issues relative to BSA/AML compliance, risk management, and process implementation, drawing upon industry experience as well as leading industry practices. Brian serves large financial institutions in the delivery of financial products and services with respect to regulatory compliance, risk management and controls, and regulatory applications concerning BSA and AML requirements. Brian last served as a Manager at a well known National Regulatory and Capital Markets Consulting Group for a "Big 4" accounting firm. He also worked as a BSA/AML and OFAC Compliance Officer for a large bank in the Chicagoland area where he served as the national process coordinator for BSA/AML investigations and compliance management. Furthermore, Brian managed interdepartmental workflows relative to BSA/AML compliance operations and communicated policies, procedures, and requirements to senior-level Bank management and operational units.
